Please be advised of changes to our payment terms effective March 15th, 2023.
All West Van Irrigation Ltd. invoices are due upon receipt. We now require credit cards to be stored to secure appointments. Charges will be applied to stored credit cards after 3 business days. Payments can also be made by cheque, credit card or by e-transfer.
PAYMENT TERMS
Payment to West Van Irrigation (“WVI”) is due on the day of invoicing unless otherwise noted within the Invoice or Proposal. Payments not received in full after 30 days of service are subject to a late fee and or Interest (36% per annum, compounded monthly). Unpaid invoices after 90 days are subject to collections which include, but are not limited to, Property Lien, Civil Court and reporting to national collection agencies. Any discounts are subject to be voided due to nonpayment or outstanding balances. Upon execution of the Invoice or Proposal, the Owner will provide payment as provided in the Invoice or Proposal. The Owner shall pay all invoices, including change orders, within the time frame outlined in the Invoice or Proposal. Work will be scheduled upon receipt of deposit as outlined in the Proposal when applicable. If your cheque is
returned for non-sufficient funds, you expressly authorize your account to be electronically debited or bank drafted in the amount of the cheque plus any applicable fees. The use of a cheque for payment is your acknowledgment and acceptance of this policy and its terms and conditions. WVI reserves the right to withhold any future work or warranty work including labor and materials at any point if payment is not made without penalty.
DEFICIENCIES
If the Client, after a job WVI has deemed Complete, has concerns regarding the completion or quality of WVI's work - the client shall notify WVI by telephone, email or hand-delivered letter within seven(7) days of job Completion so the concern can be promptly addressed and remedied. Failure to notify WVI by the means noted above will remove such concerns as a reason to withhold payment – outstanding balances must be paid prior to WVI attending for untimely Client concerns. Any issue that the client believes to be a warranty repair will be addressed with the Client's understanding that all repairs are assumed to be billable unless determined to be covered by warranty by WVI. The Client, in requesting a follow-up visit for suspected warranty repairs, accepts that all non-warranty issues [including the "curb fee" for new repairs] are billable and payable per the "Payment" terms above. WVI takes pride in its commitment to quality work and happily honours its warranty policy.
DAMAGES
Owner agrees that the only damages that may be brought by Owner against WVI relate to WVI's failure to complete the contracted work, or damage to the Owner’s property or persons while on the owner’s property. The owner agrees that any breach of this Contract shall result in damages to WVI, including all direct and incidental damages arising from the breach. Owner agrees that WVI’s damages shall include, but not be limited to: WVI’s time, resources, equipment and overhead used in mobilization, purchasing materials, and preparing plans, WVI’s loss of reasonably anticipated profits on this project or other projects occasioned by Owner’s breach or termination of this agreement, WVI’s losses arising from delays during the prosecution of this Proposal awaiting Owner’s receipt of any plans, approvals, or permits for WVI’s to complete the Work not arising from WVI’s negligence; and WVI’s reasonable attorneys’ fees and costs associated with any legal action as a result of Owner’s breach, including any claim for mechanic’s lien.
INDEMNIFICATION
Owner shall defend, indemnify, and hold WVI harmless from any and all claims, penalties, or assessments arising from, the breach of any covenant, representation or warranty herein, or from any act, omission, or misrepresentation of the Owner, and/or Owner’s employees, agents or representatives, including architects, engineers, surveyors, or others engaged to perform preliminary steps necessary for WVI to perform its work. This indemnification shall be as broad as permissible under the laws of the Province of British Columbia.
WARRANTY
All work described on the Invoice or Proposal has a two-year warranty on workmanship unless noted on the contract. Fixtures or materials may have a manufacturer’s warranty beyond WVI’s 24-month warranty – such materials are warrantied by the manufacturer and not WVI; labour for the replacement or repair of materials within manufacturer’s warranty but beyond WVI’s two-year warranty is subject to WVI standard service and/or labour rates. The client is responsible for submitting the manufacturer’s warranty registrations. Warranties are void while balance(s) remains unpaid.
